The law firm of Delcò Rossi & Partners has participated in many trials in defense of both the freedom of expression of working members of the press and the victims of excesses by the media.
Although freedom of the press is clearly a fundamental tenet of any democratic State, a well-mounted press campaign can destroy the reputation of an individual or company. Also, the press does not always do its job of criticising the powers-that-be in an independent manner. The press can sometimes be subject to the influence of partisan financial and political interests.
In order to prevent denigratory campaigns from going unpunished under the pretense of freedom of the press, Swiss lawmakers have strengthened the protection of the personality and set up a kind of right of reply in favor of persons targeted by such attacks. They have also broadened the scope of the Unlawful Competition Act to encompass working members of the press as well.
